1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Think Big Leaders AB, a company registered in Sweden with company registration number 559329-6105, located at Södermannagatan 37, Stockholm 11640, Sweden ("Castifai", "Company", "we", "us", or "our").

By accessing or using the Castifai website and service (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.

2. Description of Service

Castifai is an AI-powered content creation platform that enables users to transform video content into LinkedIn posts — with or without an attached AI-generated infographic image. The Service includes:

• Video transcription from YouTube URLs
• AI-powered content generation
• Style and voice customization
• Multi-language content creation
• Integration with third-party platforms (LinkedIn, WhatsApp)
• AI-generated images for infographics

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3.3 Account Termination

You may terminate your account at any time by contacting us at hello@castifai.com. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service, other users, or third parties.

4. Subscriptions and Payments

4.1 Free and Paid Plans

Castifai offers both free and paid subscription plans. The free plan provides access to basic features with certain limitations. Paid plans ("Pro" subscriptions) provide access to additional features, including advanced AI image generation, voice customization, multi-language support, and LinkedIn integration.

4.2 Free Trial

New users may be eligible for a free trial of Pro features. The trial period and terms will be communicated at the time of registration. At the end of the trial period, your account will revert to the free plan unless you subscribe to a paid plan.

4.3 Billing and Payment

Paid subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. Payment is processed through our third-party payment processor, Stripe. By subscribing to a paid plan, you authorize us to charge your payment method for the subscription fees.

4.4 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. Monthly subscriptions renew each month; annual subscriptions renew each year. You will be charged the then-current subscription fee upon renewal.

4.5 Price Changes

We reserve the right to change subscription prices at any time. If we change the price of your subscription, we will notify you at least 30 days before the change takes effect. The new price will apply to your next billing cycle following the notice period.

4.6 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will not be charged for subsequent billing periods
• After the billing period ends, your account will revert to the free plan
• No partial refunds will be provided for unused portions of a billing period (except as provided in Section 4.7)

4.7 Money-Back Guarantee

We offer a 30-day money-back guarantee for new paid subscriptions. If you are not satisfied with the Service, you may request a full refund within 30 days of your initial subscription purchase by contacting us at hello@castifai.com. This guarantee applies only to first-time subscribers and does not apply to subscription renewals.

4.8 Taxes

Subscription fees are exclusive of any applicable taxes. You are responsible for paying any taxes associated with your use of the Service, except for taxes based on our net income.

5. Intellectual Property Rights

5.1 Castifai's Intellectual Property

The Service, including its original content, features, functionality, design, and underlying technology, is owned by Think Big Leaders AB and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

5.2 Your Content

You retain ownership of the content you input into the Service (such as YouTube URLs and custom instructions) and the content generated by the Service based on your inputs ("Your Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free license to use, process, and store Your Content solely for the purpose of providing and improving the Service.

5.3 Generated Content

Content generated by the Service (including text, images, and other outputs) is provided to you for your use. You are responsible for ensuring that your use of generated content complies with applicable laws and does not infringe on the rights of third parties, including the original content creators of source videos.

5.4 Feedback

If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us the right to use such feedback without restriction or compensation to you.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Create, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Infringe on intellectual property rights, including using copyrighted content without proper authorization
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Engage in any activity that interferes with or disrupts the Service or its infrastructure
• Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems
• Use the Service to send spam, unsolicited communications, or malware
• Use automated means (bots, scrapers, etc.) to access the Service without our express permission
• Circumvent any usage limits, access controls, or other restrictions we implement
• Resell, redistribute, or sublicense the Service without our prior written consent

7. Third-Party Content and Services

7.1 YouTube Content

The Service allows you to transcribe and create content based on YouTube videos. You are responsible for ensuring that your use of YouTube content complies with YouTube's Terms of Service and the rights of the original content creators. We do not claim ownership of YouTube content and are not responsible for any copyright infringement claims arising from your use of such content.

7.2 Third-Party Integrations

The Service may integrate with third-party platforms such as LinkedIn and WhatsApp. Your use of these integrations is subject to the terms and policies of those third-party services. We are not responsible for the availability, functionality, or content of third-party services.

8. Disclaimers

8.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT.

8.2 AI-Generated Content

Content generated by the Service is created using artificial intelligence and may contain errors, inaccuracies, or inconsistencies. We do not guarantee the accuracy, completeness, reliability, or suitability of AI-generated content. You are solely responsible for reviewing, editing, and verifying any content before use.

8.3 No Professional Advice

The Service is not intended to provide legal, financial, medical, or other professional advice. Content generated by the Service should not be relied upon as a substitute for professional consultation.

8.4 Service Availability

We do not guarantee that the Service will be available at all times or without interruption. We may modify, suspend, or discontinue any part of the Service at any time without notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• EXCLUSION OF DAMAGES: IN NO EVENT SHALL THINK BIG LEADERS AB, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
• CAP ON LIABILITY: OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR IF YOU HAVE NOT PAID ANY AMOUNTS, FIFTY EUROS (€50).
• ESSENTIAL PURPOSE: THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION SHALL APPLY EVEN IF ANY REMEDY PROVIDED IN THESE TERMS FAILS OF ITS ESSENTIAL PURPOSE.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Think Big Leaders AB, its directors, employees, partners, agents, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your Content or any content you create, share, or publish using the Service
• Any misrepresentation made by you

Notwithstanding the foregoing, your indemnification obligations shall in no event exceed the total amount you have paid to us for the Service during the twelve (12) months immediately preceding the claim giving rise to the indemnification obligation.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms and any dispute arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

11.2 Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts located in Stockholm, Sweden. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

11.3 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us at hello@castifai.com to attempt to resolve any dispute informally. We will make reasonable efforts to resolve the dispute through good-faith negotiations within 30 days.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Think Big Leaders AB regarding your use of the Service and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

12.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
